General Conditions

The goods covered by these General Terms and Conditions are offered for sale by Enoteca Monte Fasolo srl, with registered office in Cinto Euganeo (Padua), Via Monte Fasolo 2, Italy, Tax ID/VAT No. 05460730285, hereinafter the “Supplier”.

The Supplier hereby sells and the Buyer purchases remotely, by electronic means, the tangible and intangible goods specified and offered for sale on www.vinocollieuganei.it.

The contract between the Supplier and the Buyer is entered into exclusively online through the Buyer accessing the website www.vinocollieuganei.it. Here, upon following the procedures indicated, the Buyer formalises the contract for the purchase of the goods for sale on the said website www.vinocollieuganei.it.

The contract entered into between Enoteca Monte Fasolo srl and the Buyer shall be considered concluded with the acceptance of the order issued by www.vinocollieuganei.it. Acceptance shall be deemed as tacitly given, unless otherwise communicated in any manner to the Buyer. By placing an order in the various ways provided, the Buyer declares that he/she has read the information provided during the purchase procedure and accepts the conditions set out below. The Buyer is, therefore, requested to read these terms and conditions carefully and to print them out or save them on another durable medium accessible to same.

All the sales prices relating to the products displayed and specified on the website www.vinocollieuganei.it are in euros and constitute an offer to the public, pursuant to Article 1336 of the Italian Civil Code. These prices are all inclusive of VAT and may be subject to change from time to time without notice. Once the Buyer has placed an order, the price may no longer be changed by the Supplier.

Vinocollieuganei.it guarantees that the products delivered will be the same as those specified and described on the website.

Vinocollieuganei.com does not sell alcoholic products to persons under the age of 18. The courier will NOT deliver alcoholic products to persons under the age of 18 and may request proof of identity to verify the recipient’s age.

Should any part of these terms and conditions be found invalid or unenforceable for any reason whatsoever, the remaining terms and conditions shall remain fully valid and enforceable.

By placing an order you are proposing to purchase the chosen products on the basis of these terms and conditions.

Enoteca Monte Fasolo srl will be free to accept or reject this proposal.

If the order is not accepted, the Buyer will be contacted by e-mail or telephone.

The General Terms and Conditions may be amended at any time. Any amendments and/or new conditions shall come into force the moment they are published on this page of the website, with an indication of the amendments’ effective date, which shall be at least 30 days after the date of publication on the website. In any case, the user shall be entitled to apply the General Terms and Conditions and any other contractual or economic terms in force at the time the purchase order was submitted.

Limitations of liability

1. The Supplier shall not be held liable for disruptions due to unforeseen and uncontrollable events that prevent it from executing the order within the agreed timeframe.
2. The Supplier shall not be held liable by the Buyer, except in the case of wilful misconduct or gross negligence, for network failures or malfunctions falling outside its own control or that of its subcontractors.
3. Furthermore, the Supplier shall not be held liable for any damages, losses and expenses suffered by the Buyer as a result of non-performance of the contract for reasons not attributable to same, the Buyer being entitled only to a full refund of the price paid and any ancillary charges incurred.
4. The Supplier shall not be held liable for any fraudulent or unlawful use that may be made by third parties of credit cards, cheques and other means of payment used to pay for the purchased products, provided it can prove that it has taken all possible precautions based on the latest scientific evidence and experience and on due diligence.
5. In no event shall the Buyer be held liable for payment delays or errors, provided he/she can prove the payment was made within the time and in the manner specified by the Supplier. For any matter not explicitly addressed in the contract, the rules on remote contracts shall apply. Any dispute that may arise shall be submitted to the exclusive jurisdiction of the Courts of the consumer’s place of residence or domicile.

Delivery

The shipment of products sold through the website vinocollieuganei.it is entrusted to express couriers.
Vinocollieuganei.it shall deliver the ordered products to the address provided. The delivery times quoted on vinocollieuganei.it are estimated, based on availability, normal order processing times, and the delivery times stated by the courier.

Orders are prepared by Grappa.it and entrusted to couriers on working days, from Mondays to Fridays, during office hours, from 9am to 6pm. An order is normally prepared within 48 working hours of receipt. As soon as an order is handed over to the courier in Italy, you will receive an e-mail with details and instructions on how to track delivery. If you do not receive the e-mail, please check your junk email or contact us.

Please note: if the delivered package shows obvious signs of damage, it is imperative that you sign the delivery note stating “accepted with reservation” in the space provided. Without this, we cannot make any reimbursement for the damaged package.

If, while processing your order, any unforeseen events should occur (delays preparing the order, out-of-stock product, etc.), we will inform you by e-mail or telephone of the status of your order.

At the time of payment and delivery, the Buyer must prove he/she is of legal age, since, under Italian Law no. 189 of 12 November 2012, it is forbidden to sell alcoholic beverages to persons under the age of 18.

By using this website to purchase alcoholic beverages, the user declares that he/she is of legal age and that the goods are intended for personal consumption and not for resale.

Please note: In the event of the courier applying additional charges due to incorrect address entries and/or non-delivery due to absence, thereby requiring a change of address, storage of products, or re-delivery, these costs will be charged back to the Buyer.

Withdrawal and free return of goods

Users who purchase products through the Vinideicollieuganei.it website have the right to withdraw from the purchase contract entered into with Vinideicollieuganei.it, without any penalty and without specifying the reason, within 14 (fourteen) days from the date of signing the contract for the purchase of services or from the date of receiving the goods in the case of purchases of goods.

If the Buyer decides to exercise the right of withdrawal, he/she must send a notification to the Supplier by registered letter with return receipt to the address Via Monte Fasolo, 2 – 35030 Cinto Euganeo (PD), Italy, or by e-mail to info@vinocollieuganei.it, provided said notification is confirmed by registered letter with return receipt to the address Via Monte Fasolo, 2 – 35030 Cinto Euganeo (PD), within the following 48 (forty-eight) hours. This will be certified by the stamp affixed by the post office on the receipt issued. For the purpose of exercising the right of withdrawal, sending of the above notification may be validly replaced by returning the purchased goods, provided this occurs within the same terms. This will be certified by the date of delivery to the post office or courier.

In the case of tangible goods, these shall in any case be returned no later than 14 (fourteen) days from the date of their receipt. In any event, to be entitled to a full refund of the price paid, the goods must be returned undamaged and, in any case, in normal conditions.
The costs of exercising the right of withdrawal under this Article shall be borne by the Buyer.

The Supplier shall refund the full amount paid by the Buyer free of charge within 14 (fourteen) days of receiving the notice of withdrawal.
Upon receiving the notice by which the Buyer communicates the intention to exercise the right of withdrawal, the Parties to this agreement are released from their mutual obligations, subject to the provisions of the preceding paragraphs of this article.
